Presentation is where expectation meets reality. The so-called “CSI effect” has conditioned jurors to anticipate a decisive breakthrough — a crystal-clear recording, a forensic revelation that eliminates all doubt. Most digital forensics cases don’t deliver that. What they deliver instead is surrounding digital context: evidence that a device was under a specific person’s control, used their credentials, and that contemporaneous activity points consistently in one direction. The evidence is circumstantial but cumulative, technical but human.

What Practical Preparation Looks Like

Regard’s practical guidance is clear: bring your expert in during discovery, not just at trial. Experts who help shape interrogatories, depositions, and exhibit lists ensure that the technical story being built aligns with the evidence being collected. Analogies matter — “metadata is a digital fingerprint” is something a jury can hold onto. Visuals matter — timelines and data maps that show the shape of a story, not the raw volume of every log entry.

And in voir dire and opening statements, legal teams should set expectations directly: this case is built on digital patterns, not a single dramatic moment. Jurors who understand that framework from the start are far better equipped to evaluate the evidence when it arrives.
