Un vendeur sort une lampe \u00e0 ultraviolets, la dirige vers quelques balles de golf haut de gamme de marques concurrentes et vous invite \u00e0 juger de leurs performances en fonction de la fluorescence des rev\u00eatements. Selon une plainte d\u00e9pos\u00e9e en janvier 2026 aupr\u00e8s du tribunal de district des \u00c9tats-Unis pour le district sud de la Californie, TaylorMade Golf Company, Inc. all\u00e8gue que Topgolf Callaway Brands Corporation a recours \u00e0 cette pratique et que cette d\u00e9monstration est fondamentalement trompeuse.<\/p>\n\n\n\n<p>Cette affaire soul\u00e8ve des questions relatives au marketing produit, \u00e0 la perception des consommateurs et au pr\u00e9judice concurrentiel\u00a0; des questions qui, d\u2019apr\u00e8s notre exp\u00e9rience, n\u00e9cessitent g\u00e9n\u00e9ralement une analyse financi\u00e8re approfondie et une enqu\u00eate num\u00e9rique forensique pour y r\u00e9pondre. En tant que sp\u00e9cialistes de ces domaines et connaissant parfaitement le secteur du golf, nous avons souhait\u00e9 examiner les all\u00e9gations de la plainte, leur importance et la mani\u00e8re dont les professionnels des deux parties \u00e0 un tel litige aborderaient g\u00e9n\u00e9ralement ce type de travail.<\/p>\n\n\n\n<h3 class=\"wp-block-heading\" id=\"h-what-the-complaint-alleges\"><strong>Objet de la plainte<\/strong><\/h3>\n\n\n\n<p>La plainte de TaylorMade invoque quatre chefs d&#039;accusation\u00a0: publicit\u00e9 mensong\u00e8re au sens de la loi Lanham, publicit\u00e9 mensong\u00e8re et concurrence d\u00e9loyale au sens du droit californien, et diffamation commerciale. L&#039;all\u00e9gation principale est que les repr\u00e9sentants commerciaux, ambassadeurs de marque et influenceurs de Callaway ont r\u00e9alis\u00e9 des d\u00e9monstrations sous lumi\u00e8re UV comparant la balle de golf Chrome Tour de Callaway \u00e0 la TP5 de TaylorMade, affirmant que l&#039;apparence des balles sous lumi\u00e8re UV \u00e9tait r\u00e9v\u00e9latrice de leurs performances globales et du contr\u00f4le qualit\u00e9.<\/p>\n\n\n\n<p>TaylorMade affirme que cela est trompeur pour une raison simple\u00a0: la lumi\u00e8re UV r\u00e9v\u00e8le la pr\u00e9sence et la r\u00e9partition de l\u2019azurant UV dans le rev\u00eatement d\u2019une balle (un additif cosm\u00e9tique), et non ses propri\u00e9t\u00e9s a\u00e9rodynamiques, sa trajectoire, son effet ou sa distance. Les deux fabricants appliquent deux couches de rev\u00eatement \u00e0 leurs balles de comp\u00e9tition, mais la plainte souligne qu\u2019ils utilisent l\u2019azurant UV diff\u00e9remment. TaylorMade all\u00e8gue que Callaway applique davantage d\u2019azurant UV sur un plus grand nombre de couches, ce qui rend sa balle plus uniform\u00e9ment fluorescente sous la lumi\u00e8re UV. Selon TaylorMade, cette d\u00e9monstration prouve seulement que Callaway utilise une plus grande quantit\u00e9 d\u2019additif cosm\u00e9tique, et non que la balle est plus performante.<\/p>\n\n\n\n<p>L&#039;\u00e9l\u00e9ment le plus frappant de la plainte est sans doute que les vendeurs de Callaway ont qualifi\u00e9 le TP5 de TaylorMade de \u201c\u00a0boule de boue\u00a0\u201d en raison des taches plus fonc\u00e9es visibles sous lumi\u00e8re UV. Pour tout golfeur, cette expression est lourde de sens.<\/p>\n\n\n\n<h3 class=\"wp-block-heading\" id=\"h-why-mud-ball-is-fighting-words-on-the-course\"><strong>Pourquoi l&#039;expression \u201c\u00a0boule de boue\u00a0\u201d est une provocation sur le parcours<\/strong><\/h3>\n\n\n\n<p>Les golfeurs de tous niveaux connaissent la frustration que repr\u00e9sente une balle \u201c\u00a0boueuse\u00a0\u201d. Lorsque des d\u00e9bris adh\u00e8rent \u00e0 un c\u00f4t\u00e9 de la balle, sa trajectoire devient impr\u00e9visible. Une balle avec de la boue sur le c\u00f4t\u00e9 droit aura tendance \u00e0 partir \u00e0 gauche\u00a0; avec de la boue sur le c\u00f4t\u00e9 gauche, elle partira \u00e0 droite. Cet effet est suffisamment important pour que les circuits professionnels appliquent r\u00e9guli\u00e8rement la r\u00e8gle du \u201c\u00a0lie pr\u00e9f\u00e9r\u00e9\u00a0\u201d (permettant aux joueurs de relever, nettoyer et replacer leur balle sur le fairway) lorsque les conditions du parcours le justifient.<\/p>\n\n\n\n<p>Le Masters d&#039;Augusta National fait figure d&#039;exception, et les balles boueuses y sont devenues une source r\u00e9currente de frustration pour le public. Lors du Masters 2025, Jordan Spieth s&#039;est montr\u00e9 exceptionnellement franc sur le sujet, reconnaissant que les balles boueuses avaient affect\u00e9 son jeu de fers durant les deux derniers jours et \u00e9voquant le tabou tacite qui entoure la question \u00e0 Augusta. En avril dernier, lors du Masters 2026, Scottie Scheffler a racont\u00e9 avoir ramass\u00e9 une balle pleine de boue sur le par 5 du 13e trou, au troisi\u00e8me tour, alors qu&#039;il tenait son club. Quel sera le co\u00fbt de la correction de la perception erron\u00e9e sur le march\u00e9\u00a0? Et, lorsque la loi le permet, quels profits le d\u00e9fendeur a-t-il r\u00e9alis\u00e9s gr\u00e2ce \u00e0 la campagne trompeuse\u00a0?<\/p>\n\n\n\n<p>Un expert-comptable judiciaire mandat\u00e9 dans une affaire de ce type r\u00e9aliserait g\u00e9n\u00e9ralement une analyse de rentabilit\u00e9 (\u201c\u00a0sans quoi\u00a0\u201d), mod\u00e9lisant les ventes, le chiffre d&#039;affaires et la part de march\u00e9 du plaignant en l&#039;absence des agissements reproch\u00e9s et comparant ces r\u00e9sultats aux r\u00e9sultats r\u00e9els.
