Budgets are tight, shaped by client demands, regulatory pressures, and the inherent unpredictability of uncovering the unknown (<em>\u201cI don\u2019t know what I don\u2019t know\u201d<\/em>).&nbsp; As a consultant, the ability to prioritize essential tools over tempting \u201cnice-to-haves\u201d is a defining factor in delivering value whilst maintaining fiscal responsibility.<\/p>\n\n\n\n<h3 class=\"wp-block-heading\" id=\"h-it-starts-with-a-question\">\u00a0<strong>It Starts with a Question<\/strong><\/h3>\n\n\n\n<p class=\"wp-block-paragraph\">Well, maybe a few questions. But the point stands: <em>What are we looking to achieve?<\/em> <em>\u00a0If our consultants and examiners uncover X, what does that mean for your case?\u00a0 Is there a single, critical piece of information we should focus on?\u00a0\u00a0<\/em><\/p>\n\n\n\n<p class=\"wp-block-paragraph\">This is where a consultant starts to issue spot and devise a plan of action.&nbsp; Start with the desired outcome and work backward \u2013it\u2019s not all that different from mathematics. Don\u2019t be passive\u2014ask questions, challenge assumptions, offer insights. A consultant isn\u2019t just an order-taker; their value lies in thoughtful analysis and strategic guidance.<\/p>\n\n\n\n<h3 class=\"wp-block-heading\" id=\"h-educate-and-inform-in-re-needs-v-wants\"><strong>Educate and Inform (<em>In Re: Needs v. Wants)<\/em><\/strong><\/h3>\n\n\n\n<p class=\"wp-block-paragraph\">The core role of a consultant is managing client expectations. Clients may have preconceived notions about what they \u201cneed\u201d versus what they \u201cwant.\u201d Educating them on the cost-benefit implications of their choices helps guide them toward smarter\u00a0 decisions.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">For instance, a targeted, auditable data collection is far more cost-effective than a broad \u201ccollect everything\u201d approach. By demonstrating the ROI of tools that minimize downstream review costs\u2013versus those that simply appear attractive in a proposal\u2013you help clients focus on the bigger picture. Offer your expertise, set realistic expectations, and avoid the bait-and-switch.<\/p>\n\n\n\n<h3 class=\"wp-block-heading\" id=\"h-a-typical-request\"><strong>A Typical Request<\/strong><\/h3>\n\n\n\n<p class=\"wp-block-paragraph\">\u201cI would like to file a strike-out application in fifteen days, having reviewed relevant data sources from three devices of one person.\u201d<br><br>This is a classic example of a \u201cwant\u201d disguised as a \u201cneed.\u201d The legal team must\u00a0 meet a critical obligation by 28<sup>th<\/sup> February, but with finite budgets and limited time, prioritising becomes essential. Time, much like resources, is not infinite.<br>(See: quantum mechanics and closed timelike curves for a reminder that time is a limited resource, and once it\u2019s gone, it doesn\u2019t loop back around).<\/p>\n\n\n\n<h4 class=\"wp-block-heading\" id=\"h-in-a-situation-like-this-the-plan-might-unfold-as-follows\"><em><strong>In a situation like this, the plan might unfold as follows:<\/strong><\/em><\/h4>\n\n\n\n<ul class=\"wp-block-list\">\n<li>Acquire mobile data focusing on chat messages, notes, memos, and human-authored content for review.<\/li>\n\n\n\n<li>Obtain the user\u2019s laptop data, isolating only the most relevant user-created data for review.\u00a0<\/li>\n\n\n\n<li>Retrieve email data from the user\u2019s corporate environment as a comprehensive source, bypassing the need to collect email from laptop and possibly the mobile phone.\u00a0<\/li>\n\n\n\n<li>Apply data limitations, key term searching, and, if appropriate, a technology-assisted review workflows (such as CAL\/TAR).<\/li>\n\n\n\n<li>External legal teams may use contract document reviewers (with language capabilities) to further reduce costs and save time for the client.<\/li>\n<\/ul>\n\n\n\n<h3 class=\"wp-block-heading\" id=\"h-in-the-end\"><strong>In the End<\/strong><\/h3>\n\n\n\n<p class=\"wp-block-paragraph\">In investigations and eDiscovery, distinguishing between \u201cneeds\u201d and \u201cwants\u201d isn\u2019t just about managing budgets; it\u2019s about delivering value and maintaining trust. By prioritising essentials and strategically allocating resources, consultants can achieve outcomes that satisfy both economic constraints and client expectations.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">At its core, this approach ensures every pound, euro, and dollar spent moves the case forward\u2014a philosophy that serves both consultants and clients in the long run.
