Corporate Investigations Matter<\/em><\/strong><\/h3>\n\n\n\n

Corporate investigations are essential for uncovering and addressing misconduct that breaches company policies or regulatory standards. These investigations can be triggered by a variety of events including internal whistleblower reports, HR complaints, or external government actions ranging from the relatively benign routine regulatory inquiries, to more concerning developments such as subpoenas, to the outright alarming such as execution of search warrants. The primary objective of any good faith corporate internal investigation is to conduct a comprehensive factual investigation to identify and address potential misconduct, apply appropriate discipline where warranted, and to strengthen ethics and compliance programs.<\/p>\n\n\n\n

In a significant yet often overlooked policy shift, the DOJ has recently emphasized the importance of messaging and other communications data in the hands of third parties in its assessment of corporate cooperation with its own investigations. This expanded focus now includes communications on personal devices and third-party messaging platforms, moving beyond traditional company-owned or sanctioned communications channels. This policy shift evinces a recognition that communications data in applications in addition to email \u2014 such as sanctioned messaging apps, and third-party chat platforms on BYOD devices \u2014is often the place where the most probative evidence may be found by investigators seeking to uncover misconduct. Seasoned investigators will tell you that people have learned to move communications they are worried about to channels other than those they know their employer has access to, like email. <\/p>\n\n\n\n

Increasingly, individuals attempting to obscure their involvement in any wrongdoing  prefer channels they believe are less  accessible to scrutiny. These include channels they believe are ephemeral, personally controlled, encrypted, or not subject to the same oversight as  company emails, like Slack, Teams, iMessage, WhatsApp, ProtonMail, Signal or Telegram. Despite the perceived security of these platforms, much of this data can be recovered through timely and thorough investigations. Even when message content is unavailable, details about  how and when these platforms were used can provide valuable insights into the motives and activities of those involved. <\/p>\n\n\n\n

The Race Against Time: Data Collection<\/em><\/strong><\/h3>\n\n\n\n

Timing is crucial in corporate investigations. There is an urgency in involving digital forensic experts early to prevent the loss of evidence – – whether such loss is unintentional or the product of intentional tampering. Swift and covert data collection, often conducted before employees are aware of the investigation, can preserve critical evidence. Many companies approach iDS later than they should, unaware of the existence, time-limited availability, and utility of such data until it is already gone.

Data analytics have revolutionized corporate investigations, enabling real-time analysis of vast datasets to identify red flags and key evidence. Modern analytical tools can process and analyze data almost as it is collected, significantly reducing the time to insights such analysis can bring. Data investigators can prioritize focus on the most relevant data, identify patterns and trends in the data, and promptly uncover the identities and activities of those involved in misconduct – – and the existence of additional repositories of probative data that may merit preservation and collection.

An expert in eDiscovery may not be an expert in digital forensics or cybersecurity, even though they may know more about each subject than, say, the average juror.  IT support personnel may be accomplished at \u201ckeeping the lights on\u201d for their employers\u2019 IT systems, but may not have the expertise necessary to competently conduct an eDiscovery collection campaign or task. Just as it is ill-advised for a surgeon to remove their own appendix, there are inherent risks to self-collection of data during investigations. This practice can compromise the chain of custody and the integrity of the evidence.<\/p>\n\n\n\n

Professional digital forensic experts, like those at iDS, follow stringent protocols to systematically preserve evidence and ensure its admissibility in court. If a company has a BYOD policy that impedes a company\u2019s access to its own data during an investigation conducted by its counsel and forensic team, it could potentially pose problems, especially for heavily regulated industries with significant compliance burdens. <\/p>\n\n\n\n

Future of Data Analytics in Investigations<\/em><\/strong><\/h3>\n\n\n\n

Looking ahead, iDS is optimistic about advances in AI-driven analytical tools. These technologies promise to significantly enhance the speed and accuracy of data analysis, offering deeper and faster insights into complex investigations. Such tools offer one solution to the continuous challenge of adapting to new applications and evolving digital landscapes.<\/p>\n\n\n\n

Data analytics is poised to revolutionize corporate investigations. AI-driven tools will not only streamline the analysis of vast datasets but also uncover nuanced patterns and anomalies that may otherwise go unnoticed.

Ultimately, data is at the core of effective corporate investigations. The evolving regulatory compliance and enforcement environment demands a proactive approach by experts who understand the predominant form evidence now takes: data.<\/p>\n\n\n\n
