Digital evidence now dominates the modern courtroom. But winning a case on data requires more than having the right data \u2014 it requires making twelve people who may never have thought about metadata, cloud storage, or file timestamps understand why it proves what you say it proves.<\/p>\n\n\n\n

That challenge is the focus of the sixth installment of the Regarding Evidence<\/em> column in Today’s Managing Partner<\/em><\/a>, where iDS CEO & Founder Dan Regard<\/strong><\/a> turns his attention from how digital evidence is gathered and authenticated to how it is understood \u2014 and misunderstood \u2014 in the courtroom.<\/p>\n\n\n\n

Three Problems Every Trial Team Needs to Solve<\/strong><\/h3>\n\n\n\n

Regard identifies three distinct challenges that legal teams face when presenting digital evidence to juries: comprehension, aggregation, and presentation.<\/p>\n\n\n\n

Comprehension<\/strong> is the starting point. Jurors cannot be assumed to understand the systems at the centre of most modern disputes \u2014 mobile phones, email accounts, cloud storage, operating systems. They use these tools daily without understanding how they work. Technical jargon, however precise, will lose a jury quickly. The story must be told in human terms: what did this person do, and what does the data show about when and how they did it?<\/p>\n\n\n\n

Aggregation<\/strong> is the harder problem. Traditional litigation often turns on a single powerful event \u2014 a document signed, a statement made, a photograph taken. Digital evidence rarely works that way. Instead, it builds through accumulation: hundreds or thousands of individual data points \u2014 logins, file transfers, access attempts, messages \u2014 that collectively reveal a pattern of behaviour over time.<\/p>\n\n\n\n

Regard introduces a phrase that captures this dynamic precisely: the smoking trend<\/strong>. Not a smoking gun. The power of digital evidence lies not in one dramatic moment but in the continuity of digital behaviour \u2014 sequence, frequency, and correlation that, taken together, become impossible to dismiss. For practitioners, he writes, this demands investment in the discipline of data storytelling.<\/p>\n\n\n\n

Presentation<\/strong> is where expectation meets reality. The so-called “CSI effect” has conditioned jurors to anticipate a decisive breakthrough \u2014 a crystal-clear recording, a forensic revelation that eliminates all doubt. Most digital forensics cases don’t deliver that. What they deliver instead is surrounding digital context: evidence that a device was under a specific person’s control, used their credentials, and that contemporaneous activity points consistently in one direction. The evidence is circumstantial but cumulative, technical but human.<\/p>\n\n\n\n

What Practical Preparation Looks Like<\/strong><\/h3>\n\n\n\n

Regard’s practical guidance is clear: bring your expert in during discovery, not just at trial. Experts who help shape interrogatories, depositions, and exhibit lists ensure that the technical story being built aligns with the evidence being collected. Analogies matter \u2014 “metadata is a digital fingerprint” is something a jury can hold onto. Visuals matter \u2014 timelines and data maps that show the shape of a story, not the raw volume of every log entry.<\/p>\n\n\n\n

And in voir dire and opening statements, legal teams should set expectations directly: this case is built on digital patterns, not a single dramatic moment. Jurors who understand that framework from the start are far better equipped to evaluate the evidence when it arrives.<\/p>\n\n\n\n
