Il s&#039;agit g\u00e9n\u00e9ralement d&#039;un programme \u00e0 court terme dans lequel un employ\u00e9 re\u00e7oit une fraction de son salaire normal pour ne pas travailler, en raison de pressions financi\u00e8res sur l&#039;entreprise ou d&#039;un probl\u00e8me \u00e9conomique plus large.<\/p>\n\n\n\n<!--more-->\n\n\n\n<p class=\"wp-block-paragraph\">Lorsque le COVID a violemment frapp\u00e9 l&#039;Europe occidentale, les pays ont g\u00e9r\u00e9 tous les aspects de la pand\u00e9mie sans pr\u00e9c\u00e9dent de mani\u00e8re tr\u00e8s diff\u00e9rente. Au Royaume-Uni (un terme qui peut sembler un peu fac\u00e9tieux pour le moment), les nations d\u00e9centralis\u00e9es ont mis en place diff\u00e9rentes restrictions sur le port du masque, les rassemblements et le retour \u00e0 l&#039;\u00e9cole. Le gouvernement britannique dans son ensemble \u00e9tait cependant uni dans sa <a href=\"https:\/\/www.gov.uk\/guidance\/check-which-employees-you-can-put-on-furlough-to-use-the-coronavirus-job-retention-scheme#check-how-different-employment-conditions-affect-eligibility\" target=\"_blank\" rel=\"noreferrer noopener\">Programme de maintien dans l&#039;emploi (cong\u00e9)<\/a>. Les employ\u00e9s \u00e9ligibles (ceux qui ne sont pas ind\u00e9pendants, je crois) pourraient voir 80% de leur salaire couvert jusqu&#039;\u00e0 2 500 \u00a3 par mois pendant le pire de la tourmente.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\"><strong>Quand est-ce que \u00e7a se termine ?<\/strong><br>Au moment d&#039;\u00e9crire ces lignes, le r\u00e9gime de cong\u00e9 doit expirer le 31 octobre. Certains travailleurs sont d\u00e9j\u00e0 revenus \u00e0 des horaires modifi\u00e9s, voire \u00e0 temps plein, cependant; beaucoup peuvent ne pas retourner au r\u00f4le qu&#039;ils avaient autrefois. Les estimations actuelles sont que \u00b1 3,5 milliards de livres sterling de paiements de r\u00e9gime de cong\u00e9 ont \u00e9t\u00e9 r\u00e9clam\u00e9s frauduleusement ou pay\u00e9s par erreur. <a href=\"https:\/\/www.pinsentmasons.com\/out-law\/news\/hmrc-amnesty-furlough-rule-breaches#:~:text=Employers%20who%20have%20furloughed%20employees,without%20penalties%20or%20further%20sanctions.\" target=\"_blank\" rel=\"noreferrer noopener\">Le Royaume-Uni est d\u00e9j\u00e0 bien engag\u00e9 dans une p\u00e9riode d&#039;amnistie de 90 jours<\/a> que HMRC a trac\u00e9 comme une ligne dans le sable. Ceux qui remboursent l&#039;int\u00e9gralit\u00e9 des fonds ne s&#039;exposeraient pas \u00e0 d&#039;autres sanctions ou mesures d&#039;ex\u00e9cution. La d\u00e9duction d&#039;un programme d&#039;amnistie est que les enqu\u00eates et les poursuites peuvent s&#039;intensifier \u00e0 la fin de cette p\u00e9riode.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">A partir d&#039;aujourd&#039;hui le <a href=\"https:\/\/www.theguardian.com\/uk-news\/2020\/sep\/16\/watchdog-warns-over-furlough-and-government-contracts?CMP=Share_iOSApp_Other\" target=\"_blank\" rel=\"noreferrer noopener\">Bureau national d&#039;audit<\/a> a \u00e9galement annonc\u00e9 qu&#039;il examinerait les march\u00e9s publics et d&#039;autres probl\u00e8mes \u00e0 la lumi\u00e8re des r\u00e9cents abus du r\u00e9gime de cong\u00e9.<br><br><strong>Probl\u00e8mes d&#039;emploi<\/strong><\/p>\n\n\n\n<p class=\"wp-block-paragraph\"><strong><em>R\u00e9duction des effectifs et licenciements<\/em><\/strong><br>L&#039;exigence de notification de 45 jours a r\u00e9cemment \u00e9t\u00e9 d\u00e9pass\u00e9e pour les licenciements si ceux qui participent actuellement au programme devaient \u00eatre licenci\u00e9s en cons\u00e9quence. Les entreprises devront in\u00e9vitablement prendre des d\u00e9cisions tr\u00e8s difficiles pour mettre fin \u00e0 l&#039;emploi d&#039;employ\u00e9s pr\u00e9cieux.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\"><strong>Les gens sont-ils vraiment \u00ab \u00e9teints \u00bb ?<\/strong><br>Les fronti\u00e8res entre la maison et le travail sont encore plus floues dans une soci\u00e9t\u00e9 post-COVID. Comment savoir o\u00f9 se termine l&#039;un et o\u00f9 commence l&#039;autre ? Ce n&#039;est pas facile. Si votre t\u00e9l\u00e9phone portable est toujours actif et bourdonne d&#039;activit\u00e9s professionnelles, vos employ\u00e9s r\u00e9pondent-ils \u00e0 ces questions le soir\u00a0? Des employ\u00e9s ont m\u00eame d\u00e9clar\u00e9 avoir \u00e9t\u00e9 <a href=\"https:\/\/www.theguardian.com\/uk-news\/2020\/sep\/16\/i-worked-every-day-employees-on-abuse-of-furlough-scheme?CMP=Share_iOSApp_Other\" target=\"_blank\" rel=\"noreferrer noopener\">forc\u00e9 de travailler pendant le r\u00e9gime<\/a>, qui est un probl\u00e8me d\u00e9licat \u00e0 naviguer. C&#039;est certainement un probl\u00e8me pour les avocats du travail et si vous avez d&#039;autres questions, je vous recommande fortement de discuter avec l&#039;un d&#039;entre eux.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\"><strong>Une augmentation des demandes d&#039;acc\u00e8s par sujet\u00a0?<br><\/strong>Compte tenu des tendances r\u00e9centes et de la quasi militarisation des demandes d&#039;acc\u00e8s aux donn\u00e9es (DSAR) d\u00e9pos\u00e9es contre les employeurs par les employ\u00e9s, il n&#039;est pas si fou de supposer que celles-ci continueront d&#039;augmenter. Un DSAR peut \u00eatre d\u00e9pos\u00e9 seul mais est souvent d\u00e9pos\u00e9 en parall\u00e8le avec une demande li\u00e9e \u00e0 l&#039;emploi. \u00c0 proprement parler, <a href=\"https:\/\/ico.org.uk\/your-data-matters\/your-right-to-get-copies-of-your-data\/\" target=\"_blank\" rel=\"noreferrer noopener\">les personnes concern\u00e9es exercent leurs droits<\/a> aux informations personnellement identifiables d\u00e9tenues sur eux-m\u00eames, qui peuvent \u00eatre stock\u00e9es dans une multitude de syst\u00e8mes de donn\u00e9es. Celles-ci ont toujours \u00e9t\u00e9 lourdes pour les employeurs (contr\u00f4leurs de donn\u00e9es dans ce contexte), compte tenu des flux de travail et des d\u00e9penses traditionnels.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\"><strong>Ce qui peut \u00eatre fait?<br><\/strong>Comme je le dis souvent, je ne suis pas avocat et je ne donne pas non plus de conseils juridiques, mais d&#039;un point de vue technologique et strat\u00e9gique, je vous encourage \u00e0 faire appel aux experts en triage de donn\u00e9es et services connexes.<\/p>\n\n\n\n<ol class=\"wp-block-list\" type=\"1\"><li>En tant qu&#039;employeur, comprenez o\u00f9 se trouvent vos donn\u00e9es, comment elles circulent et qui a acc\u00e8s et autorit\u00e9 pour collecter ces donn\u00e9es sur demande.<\/li><li>Envisagez une rencontre (virtuelle ou autre) avec un consultant expert pour un exercice de cartographie des donn\u00e9es afin d&#039;\u00eatre \u00e0 l&#039;\u00e9preuve du futur et mieux inform\u00e9.<\/li><li>Si vous recevez des r\u00e9clamations simultan\u00e9es, ou un nombre croissant de DSAR, envisagez de discuter avec des experts de ce qui peut \u00eatre fait pour rationaliser cela et r\u00e9duire les co\u00fbts et les heures impliqu\u00e9es.<\/li><\/ol>","protected":false},"excerpt":{"rendered":"<p>Par Timothy J.
